These Terms & Conditions apply to photography, videography and related creative services provided by Warwick Media Co.
By booking a project, you agree to the following terms.
1. Services
The services, deliverables, timescale and price for your project will be agreed in writing before work begins.
Any work requested outside the agreed scope may be charged separately. We will discuss any significant additional costs with you before carrying out the work wherever reasonably possible.
2. Payment
Payment terms will be set out in your quotation or invoice.
Where a deposit or booking payment is required, this will be confirmed before the booking is accepted.
Unless otherwise agreed, final deliverables will be provided once the agreed balance has been paid in full.
3. Cancellation & Rescheduling
If you need to cancel or reschedule a booking, please let us know as soon as possible.
We will always try to accommodate a change of date where we can.
Where work has already been completed or costs have been reasonably incurred, we may charge for those costs where permitted by law.
Any specific cancellation or deposit terms agreed when booking will apply to your project.
4. Your Responsibilities
You are responsible for providing any information, access, permissions, materials or other things reasonably required for us to complete the agreed work.
Delays caused by unavailable people, locations, information or materials may affect the agreed delivery timeframe.
Where you provide images, music, logos or other third-party materials, you are responsible for ensuring you have the appropriate rights and permissions for them to be used.
5. Editing & Revisions
The agreed price includes the editing and revisions specified in your quotation.
Requests for additional revisions or significant changes to the original brief may incur an additional charge.
We will always aim to work with you to make sure the final work reflects the agreed brief.
6. Delivery
We will provide an estimated delivery timeframe when your project is booked.
Our usual turnaround is around three working days for photography and three working days for video, although this can vary depending on the size and nature of the project.
Rush delivery may be available by agreement.
7. Copyright & Usage
Unless otherwise agreed in writing, copyright in the photographs, videos and other original creative work remains with Warwick Media Co.
Once the project has been paid for in full, you are granted permission to use the agreed final deliverables for your own business marketing and communications, including your website, social media and printed marketing.
Copyright ownership is not transferred unless this has been specifically agreed in writing.
8. Raw & Unedited Files
Unless specifically agreed otherwise, RAW photographs, unedited photographs, unused video footage, project files and editing files are not included in the final deliverables.
9. Portfolio Use
We may use selected finished work in our portfolio, website, social media and other marketing materials.
If your project is confidential or subject to an embargo, please let us know before the project begins.
10. Events, Weather & Circumstances Outside Our Control
For outdoor shoots and events, factors such as weather, lighting, venue restrictions, access and changes to schedules may affect the work.
If circumstances outside our reasonable control prevent the project from going ahead, we will work with you to find a suitable alternative where possible.
For events, we cannot guarantee that every person, moment or activity will be captured.
11. Technical Issues
We take reasonable precautions to protect project files and maintain backups.
However, photography and videography involve equipment and digital technology, and unexpected technical problems can occur.
If a significant technical issue affects a project, we will take reasonable steps to minimise its impact and, where possible, recover or recreate the affected work.
12. Liability
We will provide our services with reasonable care and skill.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited. If you are a consumer, nothing in these Terms affects your statutory rights.
For business clients, and to the extent permitted by law, our total liability arising from a project will not exceed the total amount paid or payable for that project.
We will not be responsible for indirect or consequential losses, including loss of profit, revenue or goodwill, to the extent that such liability can legally be excluded.
13. Privacy
Any personal information provided to us will be handled in accordance with our Privacy Policy.
14. Agreement
Your quotation, any written project agreement and these Terms & Conditions form the agreement between us.
If a specific written agreement for your project differs from these general Terms, the specific agreement will take precedence.
15. Governing Law
These Terms are governed by the laws of England and Wales.
